A federal judge has temporarily halted Homeland Security Secretary Kristi Noem’s plan to revoke Temporary Protected Status (TPS) for 350,000 Venezuelans. In a strong rebuke, U.S. District Judge Edward Chen ruled that Noem’s decision appeared to be based on negative stereotypes and lacked legal justification.
Chen found the termination would cause irreparable harm to TPS holders, disrupt families and livelihoods, and cost the U.S. billions in economic activity. He also criticized the move as "unprecedented," noting that no administration had ever abruptly ended a TPS program without a proper wind-down period.
Advocates welcomed the ruling, calling it a crucial safeguard against mass deportations. The lawsuit argues that Noem’s actions are unlawful and politically motivated. Venezuelans with TPS under the 2021 designation remain protected until at least September, while the case proceeds.
